“Waters of the United States” Rule: Congress Intensifies Activity to Block Proposal

Highlights
A proposed rule to redefine the key jurisdictional term “waters of the United States” under the federal Clean Water Act, jointly published in April 2014 by the Environmental Protection Agency and the Army Corps of Engineers, is moving closer to finalization. Congressional efforts to block the proposal are discussed in this update, which includes such issues as:

  • H.R.1732, Regulatory Integrity Protection Act of 2015, was passed by the full House of Representatives on May 12, 2015. 
  • S. 1140, a similar bipartisan bill, was introduced in the Senate. 
  • A presidential veto would funnel blocking efforts to appropriations bills.

This client update examines additional House activities related to the “waters of the U.S.” rule as it nears final issuance by the Corps and EPA.
