and Clean Water Act Section 401 Certification for
Sand Mining in San Francisco Bay
 
NOTICE IS HEREBY GIVEN that the San Francisco Bay Regional Water Quality Control Board (Water Board) will consider adopting Waste Discharge Requirements and Water Quality Certification orders for Hanson Marine Operations (Hanson), Lind Marine Incorporated (Lind), and Suisun Associates (a joint venture of Hanson and Lind) to continue sand mining over the next 10 years from several California State Lands Commission mineral extraction lease areas in Central San Francisco Bay and Suisun Bay, and from a private lease area adjacent to Middle Ground Island in Suisun Bay. These orders will regulate hydraulic suction dredging to obtain commercial sand that is primarily used for construction activities within the greater San Francisco Bay area and the discharge of overflow (decant water) from the dredging operations.

The 30-day public comment period for the Tentative Orders will begin on September 12, 2014, and will end at 5:00 p.m. on October 13, 2014. All written comments on the proposed orders are due by this date to the staff contact identified above. Additionally, all evidence, testimony, and exhibits to be offered at the hearing must be submitted in writing by this date to the above staff contact. Non-evidentiary policy statements to be made at the hearing need not be submitted in advance.
Prior to the hearing, Water Board staff will post on the above website any proposed changes to the Tentative Orders, along with written responses to comments received during the public comment period. The Water Board will receive oral public testimony on the proposed amendment at the hearing.
The public hearing will be conducted in accordance with the California Code of Regulations, title 23, section 649.3. Time limits may be imposed on oral testimony at the public hearing; groups are encouraged to designate a spokesperson. All exhibits presented at the hearing, including charts, graphs, and other testimony must be left with the Water Board. They will become part of the administrative record.
